Reaching an Agreement

The least contentious and most cost-effective way to resolve the legal issues arising from the dissolution of a marriage or relationship is by way of a written agreement.

When a marriage or other intimate relationship comes to an end, it can leave behind child and property-related issues requiring resolution. Individuals engaged in a civil and amicable dissolution are oftentimes able to reach agreements which resolve their outstanding issues without ever having to set foot in a courtroom. By doing so, those individuals preserve the working relationships they once (may have) had, which ultimately tends to benefit all parties involved. They can also avoid the high costs – both financial and emotional – that can accompany contested litigation.

Andrea will evaluate your case and determine whether an amicable resolution may be reached outside of court. If it appears litigation will not be necessary, she will work with you to produce a written agreement that can then be presented to the other party or his/her attorney.

What to expect

You will meet with Andrea, either remotely or in-person, to provide background information on the relationship which is ending/has ended, as well as information relating to any children of the relationship, real and personal property acquired during the relationship, and whether financial support is appropriate. If you do not already have an agreed upon resolution to the outstanding issues, Andrea will advise you as to your legal rights, as well as to the most reasonable resolution in light of your current circumstances.

Understanding your options

After you have presented the information relevant to your circumstances, Andrea will present you with the various ways you and your opposing party can resolve the outstanding issues.

Identifying issues and realities

Reaching an agreement on your legal issues involves compromise from both parties. Andrea will work with you to identify all issues which may potentially stand in the way of a resolution and discuss all options for dealing with them.

Defining outcomes

In preparing a written agreement, it is crucial to have a clear understanding of what you want. This means defining your desired outcomes with respect to alimony, custody/visitation, child support, real property, personal property, retirement, other assets and joint debts.
